Terms of Service

These terms govern your use of SharperListings (the "Service"), a web application that enhances and edits photographs of short-term rental properties. By creating an account you agree to them.

1. What the Service does

You upload photographs; the Service produces enhanced versions (light, color, geometry, sharpness, resolution) and, when you ask for them, generative edits: time-of-day and seasonal restaging, clutter removal, virtual staging, and recovery of blown-out windows. Every output is a separate version; your original is kept unchanged and can be downloaded at any time.

2. Truthful processing and generative edits

Enhancement corrects how a photo was captured and does not add, remove or alter what is in the room. Generative edits do alter content and are only ever applied when you choose them for a specific photo. Each generative output is labeled in its filename and in the photo's change log, which also names the model provider used. We commit to recording every operation applied to every photo in that change log.

You are responsible for how you use the results. Listing platforms (for example Airbnb, Vrbo and Booking.com) have their own rules about edited and staged photos; you agree to follow them, and to describe your property accurately to guests. You agree not to use generative edits to misrepresent a property's condition, size, furnishings, view or surroundings.

3. Your content

You keep all rights to the photographs you upload and to the outputs. You grant us a licence to store, process and display them only to provide the Service to you. You confirm you have the right to upload each photo (you took it, or the photographer licensed it to you for this use).

You may not upload images that are unlawful, that depict people without their consent for this purpose, or that violate someone else's rights. Uploads are screened by an automated moderation service; a photo that is flagged is not processed and not charged.

4. Credits, pricing and refunds

• Processing is paid with credits bought in packs or added by the monthly plan. Prices are shown before purchase and charged by Stripe. Prices are in US dollars; applicable taxes may be added.
• The monthly plan adds its credits each time a monthly payment succeeds and renews until you cancel, which you can do at any time from the credits page; it then ends at the close of the paid month. Credits already added stay in your balance. Partial months are not refunded.
• One credit enhances one photo. Generative edits cost two or three credits, as shown next to each edit before you start it.
• A credit is reserved when you start work and consumed when the result is delivered. If processing fails, the credit is released automatically and nothing is charged for that photo.
• Credits do not expire while your account is open. They are not refundable once purchased, except where required by law or where the Service failed to deliver and we could not release the credit. Contact us within 30 days of a purchase if something went wrong.
• Your first photo is free to preview, once per account: the result is shown web-sized with a visible mark, and the full-resolution files become downloadable after your first purchase.

5. Retention and deletion

Originals and outputs are kept for 90 days after you last opened them, then may be deleted. You can delete your account from the account page; after a 7-day grace period during which you can cancel, everything in it is permanently deleted within 30 days, including your photographs, versions and purchase history, and your sign-in identity.

6. Providers

We use third-party providers to run the Service: Clerk (sign-in), Stripe (payments), Supabase (database and private storage), Vercel (web hosting), Modal (processing), Replicate (hosting of the image models we call, currently Google Nano Banana Pro, ByteDance Seedream and Real-ESRGAN) and OpenAI (image moderation). Our providers process your images only to produce your result and do not use them to train models under the terms we have agreed with them. The current list is in our Privacy Policy.

7. Acceptable use

You agree not to interfere with the Service, to attempt to access other accounts, to resell outputs as a competing service, or to use automated means to upload at a scale beyond the limits shown in the app.

8. Disclaimer and liability

The Service is provided as is. Image results are automated and vary with the input; we do not guarantee a particular look, booking outcome or platform acceptance. To the fullest extent permitted by law, our liability to you for any claim is limited to the amount you paid us in the 12 months before the claim.

9. Changes and contact

We may update these terms; material changes are announced in the app before they take effect. Questions go to the address on the account page. Governing law and venue will be stated here once the operating entity is incorporated.
